Court dismisses Sacramento Homeless Union's appeal over clearing camps in extreme weather

The U.S. Court of Appeals said it dismissed the appeal since it hinges on a court order from last summer that expired.

SACRAMENTO, Calif. — The U.S. Court of Appeals has dismissed a case brought by advocates for the unhoused community against the city and county of Sacramento.

ABC10 previously reported attorneys for the Sacramento Homeless Union and City of Sacramento argued Thursday before the U.S. Court of Appeals for the Ninth Circuit.

The decision comes as a result of the union’s lawsuit against the city and county, arguing that moving unhoused people during extreme weather is dangerous.

The three judges issued their opinion Friday, and it was published online Monday. The decision dismisses the union’s appeal since it hinges on a court order from last summer that expired.

The judges encouraged the parties to pursue mediation instead.
