FOLSOM, Calif. — Folsom City Council repealed and deleted a section of their municipal code Tuesday night that limited the frequency of garage sales in the city.
In the original municipal code enacted in 1997, the council limited garage sales to no more than three consecutive days and a maximum of two sales per year on the same premises.
On May 1, 2020, the limitations were suspended by a COVID-19 emergency order until the order’s termination on Sept. 13, according to the city.
The ordinance was first introduced and conducted as Ordinance 1333 on Sept. 27. No changes were made to the ordinance since first reading.
The second reading occurred at the regular Folsom City Council meeting Tuesday night.
“For over two years since the suspension of Section 5.09.020, the City has received no complaint from residents about the numbers and frequency of garage sales,” according to Folsom City Council’s agenda. "To make the suspension permanent, staff is presenting a proposed Ordinance to repeal Section 5.09.020 from the Folsom Municipal Code so that City residents may hold garage sales without limitation on frequency or duration."
In the city council's agenda, officials say the city does not charge a fee for garage sales, so there is no financial impact tied to the decision
The ordinance will be effective 30 days after its passage and adoption provided it is published within 20 days after its adoption in a newspaper of general circulation in Folsom, according to the city council’s agenda.
