Rocklin Unified found to be in violation of California's education code

The California Department of Education released a report saying the district's gender notification policy violated the non-discrimination education code.

ROCKLIN, Calif. — The California Department of Education (CDE) said the Rocklin Unified School District is in violation of the state's education code. This comes after the district's board passed a parental gender notification policy back in September.

CDE notified the district through an investigation report. The report showed the district's policy was in violation of the non-discrimination provisions within the education code.

Back in September, the school board passed a policy that would require teachers to notify parents when a student asks to be identified as a different gender. 

Dozens of parents, teachers and students showed up to the board meeting to voice their concerns about the policy. They said it would harm students and put them in a position of being outed before they're ready. 

Regardless of the concerns, the board passed the policy anyway. Now, a report was sent to the district by the CDE. In the state's finding, it said the district's policy "singles out and is directed exclusively towards one group of students based on that group's legally protected characteristics of identifying with or expressing a gender other than that identified at birth."

"They're willing to take this up with California. I wouldn't be surprised if we see them file an appeal, but that that doesn't make it right," said parent Price Johnson.

A district spokesperson said it is reviewing the report. The district has not asked teachers or counselors to implement revised regulations until required negotiations have been completed. 

Following this report, the district is not allowed to implement the policy and prove to the state they're in compliance of the education code. The district also has the option to file an appeal within 30 days.
