SACRAMENTO, Calif. — A 10-year-old boy and his 53-year-old father were arrested Sunday morning in connection to a shooting that left another 10-year-old boy dead in Sacramento County Saturday afternoon.
Around 4:30 p.m. Saturday, Sacramento County Sheriff's deputies responded to an apartment complex in the 4700 block of Greenholme Drive where they found the boy with gunshot wounds.
Medics took the boy to a hospital where he died. Deputies believe the 10-year-old suspect went to his father's car to get him cigarettes before the shooting.
While in the car, the 10-year-old also allegedly grabbed a gun that was reported stolen in 2017 and bragged to his father, identified as Arkete Davis, about having it.
Deputies say the 10-year-old shot the victim once then ran into a nearby apartment unit. Investigators believe Davis hid the gun by throwing it in a nearby trash can.
In a news release, the Sacramento County Sheriff's Office said that Davis was legally prohibited from owning or possessing a firearm. He was booked into Sacramento County Main Jail on suspicion of child endangerment and accessory after the fact.
Mark Reichel, a defense attorney unrelated to this case, says trying to prove a child intended to murder someone might be difficult for prosecutors.
"It doesn't seem like it's something that person thought out, this young man thought out and planned," Reichel said.
Because of the suspect's age, Reichel says this isn't going to be a normal murder case.
"It's gonna be heard by a commissioner or a judge, not a jury. And if convicted, they can be held almost to the age of 25," he said.
Davis is being held on a $500,000 bail and is expected to appear in court on Jan. 3.
Deputies took Davis's son to the Sacramento County Youth Detention Center on suspicion of murder.
