Sacramento County DA's homeless lawsuit against city stayed for six months

The two sides gave themselves six months to work together to find a resolution.

SACRAMENTO COUNTY, Calif. — A lawsuit against the city of Sacramento's handling of the homelessness crisis has been stayed for six months, according to court documents.

The lawsuit comes from Sacramento County District Attorney Thien Ho. He filed the suit in September 2023, saying he feared for the safety of his employees and residents walking through homeless camps to get to the courthouse.

He also alleged the city failed to enforce its laws in regard to homelessness as a public nuisance, violated the water code by not keeping parks and sidewalks clean from camps and violated the fish and game code by allowing camps to pollute waterways.

Back in May, a judge said a scaled-down version of the lawsuit could move forward. However, on July 17, the city and district attorney's office agreed to mediation in order to find a resolution. As a result, the matter was stayed to Feb. 1, 2025.

"Mediation is a standard and normal process involved in all civil lawsuits. This was anticipated and is welcomed. The joint agreement to participate in mediation reflects both the District Attorney’s and the City Attorney’s commitment to addressing the unhoused crisis," Ho said in a statement.
