Stockton police shoot robbery suspect, find replica gun

Javion Holmes, 28, was critically injured after being shot at least once by a Stockton Police Department officer.

STOCKTON, Calif. — A man was critically injured Friday night after being shot by at least one Stockton Police Department officer, the department said.

Police were investigating an armed business robbery in the 5700 block of Pacific Avenue in Stockton around 9 p.m. Friday. Officers say they also received a call about a "prowler" who was "trying to hide under vehicles and possibly get into residences in the 400 block of W. Swain Road."

Police say they found the robbery suspect — now identified as 28-year-old Javion Holmes — in the backyard of a home a block north of the business on Longview Avenue.

Police say the suspect was hiding behind some debris and a narrow walkway in Raul and Laura Martinez's yard.

“(The police) were telling me to put the dogs away, lock them up in the room because they were going to come into the house with their K-9," said Raul Martinez.

Authorities say that officers tried to give commands to get the man to exit the yard via helicopter announcement and threatening to release K-9's, but he didn't comply. Police formed an arrest team and allegedly tried to take the man into custody. 

"He told the officers that he had a gun, while covering his hands with an article of clothing," said the department in a press release. "The suspect extended his hands out i front of him toward the officers as to simulate pointing a gun, and ran at the officers." 

Police say they fired a less-than-lethal shotgun round at Holmes and another officer, Ruben Meza, shot him at least once. Medics took him to a hospital where he was listed in critical condition. No officers were injured.

Police say they found a "Glock-style replica handgun and a sum of money believed to belong to the business."

For the Martinez's this was the second time they have dealt with a similar situation.

“When we lived in San Jose, we had the same thing happen to us," said Laura Martinez.

But they are thankful it did not end worse.

"I am just happy he did not try to get in here," said Raul Martinez.

"It could have been a shootout. Bullets flying through the walls, thank god it was not," said Laura Martinez.

The Stockton Police Department said that it is an ongoing investigation. The San Joaquin County District Attorney's Office said they are also investigating the shooting.
