University of California will fight for DACA's future in front of the Supreme Court Tuesday

The UC lawsuit says Trump Administration officials didn't follow rules when they decided to end DACA in 2017.

SACRAMENTO, Calif. — Deferred Action for Childhood Arrivals (DACA) will be heard by the Supreme Court on Tuesday and the University of California is one of the parties fighting for the policy’s future.

The main question in front of the Supreme Court will be, did Trump Administration officials act lawfully when they decided to end DACA in 2017?

The lawsuit brought by the University of California asks the Court to set aside the Trump Administration’s DACA decision calling it “arbitrary and capricious.”

At the heart of UC’s lawsuit is the Administrative Procedures Act (ADA). The ADA governs policymaking procedures and establishes policies for rolling back policies already in place.

The UC lawsuit argues that Trump Administration officials did not abide by those policies before ending DACA.

Trump Administration officials contend DACA was never legal in the first place, so their decision to revoke it did not need to follow the usual procedures. They also argue the move is not subject to legal review based on the same argument.

The Supreme Court’s final ruling on whether the Trump Administration can continue in its efforts to end DACA is due no later than June 2020.
