SACRAMENTO, Calif. — The 10-year-old who allegedly shot and killed 10-year-old Keith Frierson in Foothill Farms after finding a gun in his father’s car is back home, according to his family.
One of Davis’ family members spoke with ABC10 Friday and said the 10-year-old previously accused of killing Frierson is back home, and the Sacramento County District Attorney’s Office isn’t pressing charges against him.
Meanwhile, the 10-year-old’s father, 53-year-old Arkete Davis, appeared in court Friday. Davis’ family said they understand he will be held responsible for the shooting.
ABC10 previously reported Davis and his 10-year-old son were arrested Sunday with the boy being taken to the Sacramento County Youth Detention Center.
Detectives with the Sacramento County Sheriff’s Office said the formerly accused 10-year-old boy went to Davis’ vehicle to get him cigarettes. He then took a gun from inside the vehicle and bragged that his father had a gun, authorities said.
He allegedly shot Frierson once and ran into a nearby apartment, the sheriff’s office said. Detectives located a firearm in a nearby trash can, and Davis is accused of throwing it away.
Deputies said Davis was legally prohibited from owning or possessing a firearm, and the recovered firearm was reported stolen in 2017.
Frierson's family said the boy who shot Keith was a neighborhood friend and it happened after a bike race.
Davis’ family member disputed claims the shooting was over a bike race and said misinformation is hurting the family.
